The 82nd Legislature passed Senate Bill 18, which makes changes in eminent domain law.

Provisions

The following are provisions of SB 18 that impact TxDOT:

• Contains a revised bona fide provision that provides an objective standard for determining a bona fide offer
• Provides a new standard for access damages which is a material impairment of direct access on or off the remaining property that affects the market value of the remaining property
• Provides the property owner the right to repurchase the property in certain limited situations
